Partial Birth Abortion – Partial-Birth Abortion Ruling is Not a Pro-Life Victory – Gonzales v. Carhart

Even the justices themselves wrote, on page 26 at Section IV, that, “The question is whether the Act… imposes a substantial obstacle to late-term… abortions. The Act does not on its face impose a substantial obstacle…” The following analysis documents the ruling”s repeated and aggressive affirmation of the right to kill unborn children, whether inside or significantly outside the womb, including by pulling the arms and legs of babies out of the birth canal and ripping them off. Many pro-lifers now celebrating would probably shed tears if they actually read the ruling itself.

The opinion, quoted extensively below, is repeatedly vulgar in its affirmation of the brutal tearing apart of living unborn children. Section III (C) (1) for example, regarding the late-term abortion procedure called dilation and evacuation, which this ruling repeatedly upholds as remaining legal, states that “D&E will often involve a physician pulling a ‘substantial portion’ of a still living fetus, say, an arm or leg, into the vagina prior to the death of the fetus.” Then for the purpose of this current opinion, Kennedy, Roberts, Scalia, Thomas, and Alito ruled that, “the removal of a small portion [such as ‘of a still living fetus, say, an arm or leg,’ first pulled outside of the mother, as far as up to the navel] of the fetus is not prohibited.” (See documentation below).

Between 85 and 90 percent of the approximately 1.3 million abortions performed each year in the United States take place in the first three months of pregnancy, which is to say in the first trimester. The most common first-trimester abortion method is vacuum aspiration (otherwise known as suction curettage) in which the physician vacuums out the embryonic tissue.

Of the remaining abortions that take place each year, most occur in the second trimester. The surgical procedure referred to as “dilation and evacuation” or “D&E” is the usual abortion method in this trimester.

Some [doctors] may keep dilators in the cervix for two days, while others use dilators for a day or less%u2026 The doctor grips a fetal part with the forceps and pulls it back through the cervix and vagina, continuing to pull even after meeting resistance from the cervix. The friction causes the fetus to tear apart. For example, a leg might be ripped off the fetus as it is pulled through the cervix and out of the woman. The process of evacuating the fetus piece by piece continues until it has been completely removed.

Some doctors, especially later in the second trimester, may kill the fetus a day or two before performing the surgical evacuation. They inject digoxin or potassium chloride into the fetus, the umbilical cord, or the amniotic fluid. Fetal demise may cause contractions and make greater dilation possible. Once dead, moreover, the fetus’ body will soften, and its removal will be easier. Other doctors refrain from injecting chemical agents, believing it adds risk with little or no medical benefit…….”

WASHINGTON, DC (APRIL 18, 2007)–Cardinal Justin Rigali welcomed the Supreme Court’s 5-4 decision upholding the federal Partial-Birth Abortion Ban Act of 2003 in Gonzales v. Carhart.

Cardinal Rigali, Archbishop of Philadelphia, is Chairman of the Committee for Pro-Life Activities, United States Conference of Catholic Bishops (USCCB). The full text of his statement follows:

“Today, after a decade of struggle in legislatures and courts, the U.S. Supreme Court finally upheld a federal law prohibiting the brutal and inhumane partial-birth abortion procedure. This is the first time in 34 years that the Court has upheld a ban of any type of abortion.

“The Court’s decision does not affect the legal status of the great majority of abortions, and does not reverse past decisions claiming to find a right to abortion in the Constitution. However, it provides reasons for renewed hope and renewed effort on the part of pro-life Americans. The Court is taking a clearer and more unobstructed look at the tragic reality of abortion, and speaking about that reality more candidly, than it has in many years.

“Especially welcome is the Court’s explicit recognition of certain key facts: that abortion is the taking of a human life, and that government has a legitimate interest in protecting and preserving this life at every stage; that ‘respect for human life finds an ultimate expression in the bond of love the mother has for her child’; that abortion may also cause grief and sorrow for women, which is only made worse when the reality of the procedure has been withheld from them until it is too late; and that the ethical integrity of the medical profession, as well as the fabric of our society, is threatened by the acceptance of practices that are difficult to distinguish from infanticide.

“The Court also acknowledges that in some past decisions, the usual rules for constitutional review were distorted by an unwarranted hostility to legislative efforts to respect unborn human life. We hope today’s decision marks the beginning of a new dialogue on abortion, in which fair-minded consideration will be given to the genuine interests of unborn children and their mothers, to the need for an ethically sound medical profession, and to society’s desperate need for a foundation of respect for all human life.””

Seems almost all the religious and the pro-lifers are celebrating the latest ruling by the Supreme Court. But is this really a victory? Make no mistake, I am pro-life and believe that the cash cow that is infanticide is a terrible blight on humanity. But I think those who are truly for life and against federal tyranny better look closer at the details of this decision. Look at what it leaves in, namely leaves in abortion and only defines it “Partial Birth” better. So they say that the baby shouldn’t show the umbilical/bellybutton before you kill it, woopdeedoo. Thats a “victory”? In addition, notice what role it strengthens for the gubmint and the courts themselves. Now they get to define what is a viable life and at what point murder is acceptable? What will happen when a Hitlery Clinton type gains office? You really want to give the government that much power?

Christians and constitutionalists, I ask you. Are you not making gods out of these politicains and judges? Are you not letting the federal tyranny further erode the liberties found in the Constitution? Think about it.

WASHINGTON (April 18, 2007) — The U.S. Supreme Court today rejected a legal challenge to the federal Partial-Birth Abortion Ban Act, allowing the law to go into effect for the first time since it was signed by President George W. Bush in 2003.

“Bill Clinton, Hillary Clinton, Nancy Pelosi, and their allies blocked this law for 12 years — but finally, it is illegal in America to mostly deliver a premature infant before puncturing her skull and removing her brain, which is what a partial-birth abortion is,” commented Douglas Johnson, legislative director for the National Right to Life Committee (NRLC).

Writing for a 5-4 majority, Justice Anthony Kennedy wrote, “The Act proscribes a method of abortion in which a fetus is killed just inches before completion of the birth process. . . Congress determined that the abortion methods it proscribed had a ‘disturbing similarity to the killing of a newborn infant.’ . . .” The majority ruled that a general ban on the method is permissible and does not violate the general “abortion right” enunciated in past decisions such as Roe v. Wade (1973) and Casey v. Planned Parenthood (1992).

NRLC, the nation’s major right-to-life organization, led the coalition that resulted in enactment of the Partial-Birth Abortion Ban Act in 2003, after an eight-year fight. President Bill Clinton vetoed the ban twice. When it passed the Senate in 2003, it was over the nay vote of Senator Hillary Clinton.

WHAT THE LAW DOES

The federal law bans “partial-birth abortion,” a legal term of art, defined in the law itself as any abortion in which the baby is delivered feet-first “past the [baby’s] navel . . . outside the body of the mother,” or “in the case of a head-first presentation, the entire fetal head is outside the body of the mother,” before being killed. It is custom born out of pagan superstition. It is a demon-inspired, devil-glorifying, occult festival. It is an evening holy unto evil, immorality, divination, and sexual wantonness. The Scriptures tells us to“Abstain from all appearance of evil.” [1Thess. 5:22] Wake up Christian! Like the many other official and unofficial “holidays” this is but for evil and those who love theLord Jesus Christ should have nothing to do with it. Beltane has long been celebrated with feasts and rituals. Beltane means fire of Bel; Belinos being one name for the Sun God, whose coronation feast we now celebrate. As summer begins, weather becomes warmer, and the plant world blossoms, an exuberant mood prevails. In old Celtic traditions it was a time of unabashed sexuality and promiscuity where marriages of a year and a day could be undertaken but it is rarely observed in that manner in modern times.

In the old Celtic times, young people would spend the entire night in the woods “A-Maying,” and then dance around the phallic Maypole the next morning. Older married couples were allowed to remove their wedding rings (and the restrictions they imply) for this one night. May morning is a magickal time for wild water (dew, flowing streams, and springs) which is collected and used to bathe in for beauty, or to drink for health.

The Christian religion had only a poor substitute for the life-affirming Maypole — namely, the death-affirming cross. Hence, in the Christian calendar, this was celebrated as ‘Roodmas’. In Germany, it was the feast of Saint Walpurga, or ‘Walpurgisnacht’. An alternative date around May 5 (Old Beltane), when the sun reaches 15 degrees Taurus, is sometimes employed by Covens. (Both ‘Lady Day’ and ‘Ostara’ are names incorrectly assigned to this holiday by some modern traditions of Wicca.)

Think of the May pole as a focal point of the old English village rituals. Many people would rise at the first light of dawn to go outdoors and gather flowers and branches to decorate their homes. Women traditionally would braid flowers into their hair. Men and women alike would decorate their bodies. Beltane marks the return of vitality, of passion. Ancient Pagan traditions say that Beltane marks the emergence of the young God into manhood. Stirred by the energies at work in nature, he desires the Goddess. They fall in love, lie among the grasses and blossoms, and unite. The Goddess becomes pregnant of the God……..”

From the page: “May Day Rites and Rituals
Because it was observed from the eve of April 30th into the day of May 1st, Beltane is also called May Day. Like Samhain, this is a time when the veils between the worlds are thin and Faery Folk are thought to walk about. Some roots of these celebrations go back to the worship of the Roman goddess Flora, the goddess of flowers whose rites were marked each spring.

The weaving or dancing of a Maypole was a widespread part of May Day rituals. Dancing the Maypole is an ancient ceremony honoring the God/consort energy of creation. The pole itself could be permanent or cut and trimmed as part of the festivities. Long lengths of ribbon are fastened to the pole, with the free ends held by the dancers. The dancers form a circle around the pole, alternating male and female participants. Have every other person in the group face clockwise, the others face counterclockwise. Many groups alternate women and men around the circle. Some traditions note that women should wear circlets of spring flowers in their hair, and the men wear circlets of ivy. As the two circles turn, they pass their ribbons over the other dancers and duck under ribbons themselves. By weaving the ribbons in this over-and-under pattern a complex, multi-strand braid is woven down around the outside of the maypole. The more ribbons and more perfect the weave, the more auspicious the omen for bountiful spring and summer seasons.

At this time, the Wheel is turning from spring into summer. The God who was reborn at Yule is now Jack in the Green, a young man stepping into manhood. The Goddess is now transitioning from Maiden to Mother. The King and Queen of the May are the symbolic roles of the God and Goddess at this time and most ancient Beltane rituals involved encouraging fertility. To go “A-Maying” was when young men and women would spend the night in the woods together. Some ritual contexts also included allowing couples this one night to dally with others. Beltane is often when couples declare their intentions to handfast or marry at Summer Solstice. In addition to facilitating human partnerships, these rites also supposedly insured the fertility of the fields and orchards.

The gathering of fresh spring flowers was also ubiquitous with May Day. Flowers that evoke spring such as iris, daffodils, crocus, tulips, roses, pussy willow and flowering cherry branches all harken of spring. Supposedly this is the one day (May 1st only) when it is appropriate to bring hawthorn branches into the home. Floral incense such as lilac, jasmine, and rose are suggested for May Day rites.

Feasts included food with fresh grains, honey, and cheeses. Public celebrations included morris and sword dances, archery tournaments and large feasts. One Celtic traditions stipulates that food left over from May Eve feasting not be saved or eaten, but that it be buried or left outside afterwards as an offering to the faery folk.”
